1. Prices

Prices are based in pounds sterling, and converted to US dollars or Euros at the prevailing rate.

VAT will be added automatically for customers within the EU, customers outside the EU will be responsible for paying any import duty or taxes at their country's border. VAT receipts are issued with every order should you need to reclaim this.

Every effort will be made to maintain the prices of Goods, however Company reserves the right to vary the prices at any time without prior notice.

2. Orders

There is no minimum order value.

All orders are subject to these terms and conditions when ordering through shop.elesar.co.uk, regardless of any alternative arrangements made directly between Customer and Company.

Orders are processed between the 09:00-17:30 hours Monday to Friday only.

Company reserves the right to decline to trade with any Customer.

No order may be cancelled once checkout is complete without written permission from Company. Goods that are custom (cut to size, made to measure) or similarly not in the standard shop SKU are non cancellable and non refundable.

Title to the Goods remains with Company until payment is received in full.

Any OEM warranty or guarantee for the Goods shall transfer to the Customer at the time of purchase, though not all Goods convey such a warranty or guarantee.

3. Delivery

Goods will be delivered by any method of delivery deemed suitable by Company. Services will be provided by means of electronic or telephone communication.

Orders may be split to help logistics at Company's discretion, for example where large items might damage smaller items if packed in the same consignment. This does not affect the cost of carriage to Customer.

The Company will use best endeavours to delivery on time, but in no circumstances shall it be liable to compensate the Customer for non-delivery or late delivery. Time for delivery will not be of the essence.

Customer will inspect the Goods promptly upon delivery and report any damaged, missing, or defective items immediately to Company. Goods will otherwise be deemed to have been accepted automatically within 7 days of receipt by Customer.

4. Returning items

Returns will not be accepted without a valid RMA number.

Goods which arrive damaged or faulty should be carefully packed and returned using the method requested by Company, this may not be the same delivery method by which Goods were initially delivered. They will be repaired or replaced at Company's discretion within 7 working days, subject to stock availability.

Goods ordered in error or no longer required by Customer will be subject to a 10% restocking fee, or £5, whichever is the larger. Goods that are custom (cut to size, made to measure) or similarly not in the standard shop SKU cannot be returned. Customer is responsible for returning the items to Company, and paying any shipping or insurance fees for their return. Goods must be returned in their original unopened packaging in a resaleable condition.

Goods which are modified, repaired, used outside their operating range, or misused by Customer cannot be returned.

If Customer is classed as a 'consumer' under the Consumer Protection (distance selling) Act 2000, Goods can be returned unused and unopened at Customer's expense for a full refund of the purchase price of the Goods, excluding carriage, provided they are returned within 7 days.

5. Liability

Liability of Company for non-delivery or late delivery shall be limited to the value of the Goods or Services.

Company has no liability to Customer for any injury, death, damage, direct or indirect or consequential loss howsoever caused or arising from use of the Goods, their performance, or any act or omission of Company (including negligence, omissions, or errors made in descriptions).

Goods may be subject to intellectual property rights including patents, knowhow, trademarks, copyright, design rights utility rights, database rights and or other rights of third parties. No right or licence is granted to the Customer, except the right to use the Goods in Customer’s ordinary course of business. Company shall have no liability whatsoever in the event of any claim of infringement of any such rights howsoever arising. In particular, without limiting the above, title in any software program forming all or any part of the Goods is reserved to Company and/or its suppliers. Customer is responsible for informing itself of the terms of its licence or use and paying any royalty payable.

All contracts between Customer and Company shall be governed by English Law, and Customer submits to exclusive jursdiction of any competant court in England.

6. Definitions
